Please read these terms and conditions carefully before applying to join our Independent Podcaster Program “The Heard”.

Acknowledgement

These are the Terms and Conditions governing Your participation in the Independent Podcaster Program “The Heard” (the “Program”) on the Heard.FM platform (“the Platform”).  Submitting Your application to join the Program constitutes Your agreement to the Terms.

By submitting Your application to join the Program You agree to be bound by these Terms and Conditions.  If You disagree with any part of these Terms and Conditions, then You should not apply to join the Program.

To Apply:

Application to join the Program is by invitation only.  You acknowledge that You have received an invitation directly from Heard.FM and that You are the owner of the podcast and RSS Feed that You are submitting an application for.

Applications may only be submitted via the submission form on our website.

Heard.FM will review and evaluate Your application and eligibility and will notify You if accepted.  The decision and determination of acceptance into the Program shall be by Heard.FM and in its sole discretion.  Heard.FM may reject Your application if Heard.FM determines (in its sole discretion) that You do not meet the eligibility requirements of the Program or are otherwise not in compliance with the Policies.

Heard.FM is not responsible for any incorrect or inaccurate information supplied by You during the application process or thereafter.  You represent and warrant that all information submitted by you is truthful and accurate, and that You will maintain the accuracy of such information at all times.

By submitting Your application for the Program, You acknowledge and agree to the following:

• You are the owner of the IP and RSS Feed for which you are submitting to the Program.  
• You are providing Heard.FM with an unconditional right of use to Your artwork, podcast name, and all material provided by You to Heard.FM for use in the Heard.FM app for iOS and Android, on the Heard.FM website, by Heard.FM in social media postings, and in online as well as offline marketing efforts by Heard.FM.  
• You will not use the Heard.FM name or logo without prior written consent from Heard.FM.

You further acknowledge that Heard.FM has not provided (either expressed or implied) any commitment, guarantee, requirement or entitlement to You regarding specific number of ads, promotion of your podcast, or any compensation whatsoever.

If your application for the Program is approved, You acknowledge and agree that approval is not an agreement or an offer of employment.

Termination

You acknowledge and agree that Heard.FM may terminate or suspend Your participation in the Program immediately, without prior notice or liability, and at the sole discretion of Heard.FM for any reason whatsoever, including without limitation if You are in breach or violation of these Terms, become no longer qualified for the Program, become involved in any situation or occurrence that at the sole discretion of Heard.FM could reflect unfavorably upon Heard.FM, and or without cause for any reason.

Termination will become effective immediately and You will be notified by Heard.FM of termination through the approved email address that Heard.FM has on file for you at that time.  You acknowledge and agree that Heard.FM will have no liability to you for any losses incurred by You as a result of Your termination from the Program.

You acknowledge that Heard.FM reserves the right in its sole discretion to suspend or terminate the Program at any time without prior notice. 

Representations and Warranties

You represent and warrant that you are over the age of 18 or age of legal majority in your place of legal residence and otherwise have full right, power, and authority to enter into these Terms on behalf of yourself and any entity for whom you are acting on behalf of.  You further acknowledge that Your participation in the Program will not violate any contract or agreement that You are a party to or otherwise bound by, or otherwise interfere with any third-party rights or obligations.

Changes to These Terms

Heard.FM reserves the right, and at the sole discretion of Heard.FM, to modify or replace these Terms at any time.  We will notify you of any changes by posting the new Terms on this page.

By Your continued participation in the Program after those revisions become effective, You agree to be bound by the revised Terms.

Any rights not expressly granted herein are reserved by Heard.FM.
